performance shall not be of the essence of this agreement. 3.3 You will be allowed up to a maximum number of users (“Total Users”) during the Subscription Period and the details of such users shall be specified by you, to us, in writing prior to the commencement of the Services. In our sole discretion we may allow you to transfer a user to another of your employees with our prior written approval (subject to a maximum of 20% of the Total Users that have been granted during the Subscription Period).
